G&M Eyecare Back to School with Emma McKeon Competition
1) Information on how to enter forms part of the terms and conditions of entry into G&M Eyecare Back to School with Emma McKeon Competition (promotion).
2) The promoter is IPIC Pty Ltd, trading as George & Matilda Eyecare (ABN 16 607 043 818) of Level 1, 148 Foveaux Street, Surry Hills NSW 2010 (telephone number 1300 056 225) (Promoter).
Duration
3) The promotion commences at 9:00am AEDT on Monday, 6 January 2025 and closes at 11:59pm AEDT on Sunday, 9 February 2025 (Promotion Period). The Promoter reserves the right to amend the Promotion Period, draw dates and notification of winner dates at any time (subject to regulatory approval) by providing reasonable notice to entrants.
Eligibility to enter
4) Entry is open to people aged 18 years or over (Eligible Entrants), excluding directors, management, employees and their immediate families of the Promoter.
Entry into the promotion
5) To enter the promotion, Eligible Entrants must during the Promotion Period purchase any product from George & Matilda Eyecare (in-store or online) and complete an online entry form including contact details, the name of school who the entrant wishes to nominate to
receive the prize and receipt number as proof of purchase. Eligible Entrants are permitted to enter more than once but are limited to 1 entry per purchase receipt. Eligible Entrants must only nominate a school in the entry form that:
6) The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an entrant’s identity, proof of purchase).
Selection of Winner
7) A winner will be drawn randomly at 12 noon on Monday, 10 February 2025 at George & Matilda Eyecare Support Office, Sydney. The first valid entry drawn will win the prize.
The prize
8) The prize is for Emma McKeon to attend the swimming carnival or event hosted by the school nominated in the winner’s entry in accordance with clause 5 during the week commencing 10 March 2025. The prize includes up to a 2 hour visit by Emma McKeon during which she will speak to students, hand out any prizes and pose for photos. The prize is valued at $1,500. If the winner does not accept the prize, they will forfeit the prize and the Promoter is not liable to compensate the winner or for any loss or damage arising from the winner’s failure to accept the prize. The prize cannot be exchanged or redeemed for cash, or transferred to another person.
9) If the prize is not available for any reason, the Promoter reserves the right to substitute the prize with another item of equal or greater value if the winner agrees in writing and subject to any approvals from regulatory authorities. If the winner does not agree despite reasonable attempts by the Promoter to reach an agreement and the prize is not available due to circumstances beyond the Promoter’s control, the Promoter may substitute the prize with another item or items determined by the Promoter to be similar and of equal or higher value.
Notification of the winner
10) The winner will be notified by phone and email by Tuesday, 11 February 2025. The Promoter will take all reasonable steps to contact the winner. The winner’s details will be published at https://georgeandmatilda.com.au/competition/back-to-school-2025. If the winner cannot be contacted within 3 business days, the Promoter reserves the right to redraw another winner through a second chance draw.
Second Chance Draw
11) If necessary, a second chance draw will be held at 12 noon on Monday, 17 February 2025 at George & Matilda Eyecare Support Office, Sydney. The first valid entry drawn will win the prize.
12) The winner will be notified by phone and email by Tuesday 18 February 2025. The Promoter will take all reasonable steps to contact the winner. The winner’s details will be published at https://georgeandmatilda.com.au/competition/back-to-school-2025.
Entry details and privacy
13) Entry details remain the property of the Promoter. Entrants consent to the Promoter using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) (Materials) in any media without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize.
14) By entering into the Promotion, you agree and acknowledge that:
a) to the extent you have any intellectual property rights in the Materials by virtue of creating or appearing in them, you grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable license to reproduce, publish and otherwise use the Materials for the purposes of marketing the Promotion and the Promotor, including on the Promotor’s social media sites, without being granted an opportunity to review or approve the Materials before they are used;
b) you unconditionally and irrevocably consent to any act or omission of the Promoter or any person acting on its behalf that would otherwise infringe any of their moral rights (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights) in the Materials or any performance embodied in the Materials in the course of those Materials being used for promotional purposes (including the Materials being used without identifying them, or being modified in any way);
c) to the extent permitted by law, you waive all Moral Rights you may have in the Materials or any performance embodied in the Materials that arise outside Australia; and
d) you agree not to institute, maintain or support any claim or proceeding for infringement of your Moral Rights in the Materials or any performance embodied in the Materials.
15) Entrants consent to the Promoter using personal information provided in connection with this promotion for the purposes of facilitating the conduct of the promotion and awarding any prizes (including to third parties involved in the promotion and any applicable statutory authorities). Without limiting the foregoing, entrants’ personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy Policy which can be viewed at https://georgeandmatilda.com.au/general/privacy. The Privacy Policy also contains information about how you may opt out, access, update or correct your personal information, how you may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with.
Standard Terms
16) If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (including the Australian Consumer Law):
a) to disqualify any individual; or
b) to modify, suspend, terminate or cancel the Promotion, as appropriate, subject to regulatory approval.
17) Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), or similar consumer protection laws in the State and Territories of Australia (Non-Excludable Guarantees).
18) Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for any loss or damage that you may suffer in connection with accepting, redeeming or using any of the prizes, except to the extent the loss or damage is caused by the Promoter’s negligence or breach of these terms and conditions.
19) The Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability for indirect or consequential loss or damage that you may suffer in connection with this Promotion including loss of opportunity, loss of profit, personal injury or property damage.
